Mitigation Banking Law and Regulations

Description: The 1997 Washington State Legislature passed a
law--Chapter 90.84 RCW--directing the state to adopt rules for certifying
wetland mitigation banks. Draft rules are prepared. The rule outlines
procedures for the operation, monitoring, and implementation of wetland mitigation
banks. It also establishes a predictable process for certifying mitigation
banks. Among other concepts, the rule addresses the definition of service
areas, the determination and release of credits, performance standards, and
long-term financial assurances.
Outcome: None yet. Reliable, coordinated, and consistent
protocols for wetland mitigation banking.
